The CNCTR may be referred to by any person wishing to verify that no intelligence-gathering techniques are being or have been unlawfully used against them.
The CNCTR's power of verification applies only to techniques used by intelligence services. The commission therefore has no jurisdiction over surveillance measures ordered by the judicial authorities, which are subject to the control of that authority alone.
The use of surveillance measures by private individuals is prohibited and constitutes a criminal offense, which also falls within the sole jurisdiction of the judicial authorities.
If you would like the CNCTR to verify that no intelligence-gathering techniques have been used against you in an irregular manner, you must send a complaint by mail to the following address:

Your complaint must include the identifiers (phone number, email address, etc.) for which you want the necessary checks to be carried out.
You must attach the following to your request:
The checks carried out by the CNCTR only concern the possible use of intelligence-gathering techniques in relation to you and do not concern members of your entourage. If they wish to have checks carried out on them, it is up to each of them to submit a complaint to the CNCTR.
Upon receipt of your complete complaint, the CNCTR will verify that no intelligence-gathering techniques have been used improperly in relation to you. It will carry out the same checks as those it conducts on its own initiative.
If it finds any irregularities, it will order the service to stop the intelligence-gathering technique in question and destroy all the data collected.
If the service refuses, it will refer the matter to the Prime Minister and, if necessary, lodge an appeal with the Council of State itself.
In all cases, you will be informed that the requested checks have been carried out. However, the law prohibits the CNCTR from confirming or denying the use of a technique against you: this would be a violation of national defense secrecy.
Once you have received the letter informing you that the necessary checks have been carried out, you have two months to submit a request to the Council of State regarding the use of the intelligence techniques mentioned in Title V of Book VIII of the Internal Security Code in relation to you.
If the commission does not respond to you within two months of the date of filing your complaint, you may refer the matter to the Council of State within four months of that same date.
